
Terms and Conditions of Business
1. General Provisions

Agreement: All work and materials are provided by The Board Service Limited on the following conditions. Acceptance of such work and materials by The Customer constitutes The Customer’s full assent and acceptance of these terms.

Definitions: The Customer: The individual, partnership, or company named on the online management portal.

The Board Service Limited: The business licensed to trade as The Board Service.

Instructions: The Customer shall provide all instructions regarding the erection, maintenance, and retrieval of signboards exclusively via The Board Service Limited’s online system.

Jurisdiction: This agreement is made under English law and shall be subject to the exclusive jurisdiction of the English courts.
2. Pricing and Payment

Invoicing: All invoices will be raised by The Board Service Limited, to whom all debts are assigned and all payments must be made via BACS transfer.

VAT: All prices quoted by The Board Service Limited are net of Value Added Tax (VAT).

Payment Terms: The Board Service Limited’s terms are strictly 28 days from the date of invoice.

Late Payment Surcharges: Any invoice older than 56 days will automatically incur a 5% charge per month until the debt is settled. The Customer remains liable for these charges even if the invoice is addressed ‘care of’ a third party.

Recovery Costs: If The Board Service Limited instructs agents to recover outstanding sums, The Customer shall be liable to pay all costs, fees, disbursements, and charges, including all debt recovery, legal, and insolvency fees incurred by The Board Service Limited.

Third-Party Billing: If The Customer instructs The Board Service Limited to invoice a third party, the responsibility for payment remains solely with The Customer. The Board Service Limited is at liberty to notify third parties of overdue invoices.

Price Reviews: Prices are reviewed annually by The Board Service Limited on 1st May, with changes applied from 1st June. The Board Service Limited uses the CPI (Consumer Prices Index) to calculate increases and will communicate these via the online portal and email.
3. Service Charges and Refusals

Refused Signage: If a commercial sign is refused at the location, The Board Service Limited will charge The Customer in full.

Second Attempts: If The Customer contacts The Board Service Limited within 14 days of a refusal to request a second attempt, this will be carried out with an additional charge at the "Labour Only" cost price. If no contact is made within 14 days, the sign must be paid for in full.

Safety & Technical Issues: Any sign that The Board Service Limited cannot erect for safety or technical reasons (through no fault of The Board Service Limited) will be charged in full. The Board Service Limited will hold the sign for 30 days for The Customer to use elsewhere at the "Labour Only" cost price.

Suspension of Work: Should work be suspended at the request of The Customer for 30 days, The Board Service Limited is entitled to payment for work already carried out, materials ordered, and additional costs.
4. Liability and Indemnity

Permissions: The Customer shall obtain permission from the property owner for the erection of signboards prior to giving instructions to The Board Service Limited.

Height & Insurance: The Board Service Limited will erect signboards up to a maximum height of 5m and maintains £5,000,000 Public Liability insurance.

Exclusions of Liability: The Board Service Limited accepts no liability for signs, posts, or fixings not erected or serviced by The Board Service Limited, or where a sign has been moved or tampered with by The Customer, the property owner, or any third party.

Planning Compliance: The Customer accepts sole responsibility for legal and planning requirements and agrees to indemnify The Board Service Limited in respect of any breach of such requirements.

Property Damage: The Customer acknowledges that fixing angled boards to buildings will leave nail or screw holes upon removal; The Board Service Limited cannot be held responsible for this.
5. Board Insurance and Inspections

Initial Coverage: All signage produced and erected by The Board Service Limited is covered by Public Liability insurance for 12 months from the date of our last visit to the property.

Mandatory Inspections: After 12 months, The Board Service Limited will perform an insurance inspection to verify the condition of the board and fixings. There is an additional charge for this inspection and any remedial work required to warrant a further 12 months of cover.

Insurance Waiver: If The Customer is unwilling to abide by these terms, The Customer must provide written instructions on official company letterhead to waive the inspection. The Board Service Limited reserves the right not to accept responsibility for uninsured signage.

Automatic Removal: The Board Service Limited will collect all standard agency boards in situ for 12 months without insurance inspections and will charge The Customer for that removal.

Removal Policy: If The Customer fails to respond to an enquiry to extend insurance within 2 weeks, The Board Service Limited will remove the signage. All signage will be removed after 2 years and invoiced to The Customer unless specifically agreed otherwise.

Weather Conditions: The Board Service Limited notes that boards may be delayed in adverse weather (high winds, snow, etc.). The Board Service Limited will endeavour to install them as soon as safely possible.
6. Third-Party Sign Removal

If The Customer requests the removal of another agent's sign, The Board Service Limited requires the freeholder to confirm this, or The Customer must provide an email stating they have the freeholder's consent.

The Customer is liable for all costs (including the production and erection of a replacement sign) if the information supplied by The Customer proves to be inaccurate.
